How to Appeal a Retail Park Parking Fine

Fined while visiting multiple shops at a retail park? Learn how multi-store receipts and unclear boundary signage can cancel your fine.

Fined at a Retail Park?

Retail parks often host dozens of stores (e.g., Currys, B&Q, Boots, Next, Marks & Spencer) alongside food outlets and cinemas. Operators like Group Nexus (CP Plus), Smart Parking, UKPC, and Euro Car Parks install ANPR cameras with short maximum stay limits (e.g. 2 or 3 hours).

However, visiting multiple retailers or combining shopping with dining routinely takes longer than the arbitrary time limit, leading to unfair charges.

Consumer Rights Act 2015 & Prominence of Terms

Under the Consumer Rights Act 2015, contractual terms and time limits must be prominent and transparent. Where retail complexes encourage prolonged patronage, contradictory short parking restrictions are vulnerable to challenge.

Step 1: Gather Multiple Receipts

If you visited more than one business in the retail park, collect receipts, card transaction logs, cinema tickets, or restaurant bookings from your visit.

Combining multiple receipts proves that your prolonged stay was entirely commercial activity supporting the park's tenants.

Step 2: Key Retail Park Defences

  1. Unclear Signage at Entrances: Did the entrance signs clearly specify that the time limit applies across the entire park regardless of how many stores you visit? If not, cite inadequate notice under Lord Denning's Red Hand Rule and BPA Code Appendix B.
  2. "No Return Within" Violations: If you visited in the morning and returned in the evening, ANPR "double dipping" errors frequently fail to record the intermediate departure, falsely recording one massive overstay.
  3. Retail Park Management Direct Appeal: Contact the managing agent of the retail park (e.g., British Land, Savills, CBRE) directly with your receipts for tenant cancellation.
