Understanding Contravention Code 27
Code 27 is enforced where a vehicle is parked adjacent to a dropped footway intended to facilitate pedestrian crossing, cycle tracks, or vehicle access to premises.
Key Appeal Grounds
- Own Driveway Consent Exemption: Under Section 86(3) TMA 2004, parking across a dropped footway providing access to residential premises is fully exempt if parked with the permission of the occupier.
- Continuous Loading: Loading or unloading of goods is permitted for up to 20 minutes across a dropped kerb provided it could not reasonably be carried out elsewhere.
- Immaterial Overhang (De Minimis): If only the bumper marginally overhung the sloping kerb stone without obstructing the flat level footway, adjudicators routinely cancel the PCN under the de minimis principle.
