Understanding Contravention Code 02
Code 02 is issued when a vehicle is stopped or loading on a road with yellow kerb markings (chevrons/blips) indicating that loading is prohibited.
Key Appeal Grounds
- Boarding Exemption: Even where loading is prohibited, picking up or dropping off passengers remains permitted provided no unnecessary delay occurred.
- Missing Kerb Markings: If the yellow transverse stripes on the kerb have worn away or are not visible due to snow, mud, or resurfacing, the loading ban cannot be enforced.
- No Observation Period: Councils must provide adequate observation time before issuing Code 02 to establish that the vehicle was stationary and not momentarily held in traffic.
